Learning Disabilities
The NC Policies Governing Programs for Children with Disabilities defines a Specific Learning Disability as follows:
Specific Learning Disability. (i) General. Means a disorder in the processes involved in understanding or in using language, spoken or written, that may manifest itself in the impaired ability to listen, think, speak, read, write, spell, or to do mathematical calculations. Conditions may include, but are not limited to, dyslexia and dyscalculia.
(ii) Disabilities not included. Specific learning disability does not include learning problems that are primarily the result of visual, hearing, or motor disabilities, of intellectual disability, of serious emotional disturbance, or of environmental, cultural, or economic disadvantage.
For a student to be eligible for special education services in North Carolina as having a Specific Learning Disability, the following five criteria must be met:
1.Rule out as determinant factors: lack of appropriate instruction in reading and/or math by qualified personnel; limited English proficiency.
2.Rule out as Primary factors: vision, hearing, motor disability; intellectual disability; environmental disturbance; cultural factors; environmental or economic influences; loss of instructional time.
3.Inadequate achievement: does not meet age or grade level standards when provided learning experiences and instruction appropriate for the child's age or grade.
4.Insufficient progress: lack of response to instruction/intervention OR responds at a rate insufficient to reduce risk over time.
5.Adverse effect and requires special education.
